Terms of service

Draft: these texts are pending legal review and the company details are not filled in yet.
General terms for businesses that use HolaRoom. Each customer signs a contract with [Razón social]; where it says something different, the contract wins.
The service
HolaRoom lets a hotel publish guest pages, take orders and requests, and pass them to its team by WhatsApp, SMS, email or the admin. The guest's WhatsApp or SMS message is sent from the guest's own app; HolaRoom doesn't send it. Features in Beta may change or be removed.
Accounts
Accounts are set up for each customer; the owner invites the rest of the team. Keep access to your email secure: anyone who can read it can sign in. You're responsible for what your team does in the account.
Your content and your guests
- You own the texts, photos, prices and products you publish, and you're responsible for them being accurate and lawful, including prices, allergens and taxes.
- You're responsible for the products and services you sell to guests and for collecting payment.
- You're the controller of your guests' data: publish a privacy notice and link it in your guest page settings. We process guests' data as your processor, under the data processing agreement in your contract.
Fair use
Don't use the service for anything unlawful, to send spam, to upload malware or content you don't have rights to, or to probe or overload it. We may suspend an account that does, after warning you when we can.
Availability and support
We aim to keep the service running at all times but don't promise uninterrupted availability unless your contract sets a service level. We may update the software to improve it or keep it secure.
Fees, suspension and ending
Fees, the term and renewal are in your contract. If the contract is paused or ends, the account is suspended: guest pages stop working and the admin is closed. Before it ends, the owner can export the account's data from the admin's Settings; after that we delete it, except what the law requires us to keep.
Liability
We are liable for damage we cause intentionally or through gross negligence. Otherwise, and as far as the law allows, our liability is limited to the fees paid in the 12 months before the claim, and excludes lost profits and indirect damage.
Changes and law
We may update these terms; we'll tell account owners by email 30 days before a change that affects them. Spanish law applies, and disputes go to the courts of the city of our registered address.
